What is an Apostille?

An apostille is a special certificate affixed to a public document that authenticates the signature and seal of the issuing official.

It serves as a declaration to other countries, assuring them of the document's authenticity and the official’s signature. This certification allows the document to be effectively utilized in foreign countries that are part of the Hague Apostille Convention (1961).

Imagine you have a birth certificate issued in the United States and must use it in France. French authorities may recognize it only if it has an apostille attached, which confirms that the document is genuine and issued by a certified official.

You can find more information about apostilles in this article on our blog.

Why Is An Apostille Important?

It is important because it provides a secure, legally recognized method for authenticating documents intended for international use. Recognized in over 150 countries, it verifies the authenticity of official documents such as birth and marriage certificates, diplomas, and other legal documents.

This authentication is crucial for individuals traveling, studying, or working abroad, as it simplifies verifying their identity and the legitimacy of their documents. This, in turn, facilitates easier access to essential services and business opportunities in foreign nations.

In the United States, apostilles are issued by the Secretary of State, stating the document's origin. Specific requirements vary by state, making it essential to research the process carefully.

Steps for New York Apostille

1. Notarization

Notarization is the official fraud-deterrent process that ensures a document's authenticity and trustworthiness. Its primary value lies in a notary's impartial screening of a signer for their identity, willingness, and awareness to identify and prevent document fraud.

2. County Clerk Authentication

Before submitting an apostille or certificate of authentication to the Department of State, documents must be authenticated by the County Clerk or a state official. If the Notary Public notarized the record, it must be submitted to the clerk in the County where the Notary is qualified. If a birth or death certificate issued in any of the five boroughs of New York City needs to be apostilled—it must bear a letter of exemplification.

3. Department of State Apostille

The third step involves the New York State Department of State issuing an apostille or certificate of authentication. You must complete an application form and attach the properly authenticated documents to proceed. A fee is also required. Notary911 offers a 1—to 2-business-day apostille service for New York State-issued documents.
